8. Data retention period

We retain data only for as long as necessary to fulfill the purposes for which they were collected, in compliance with applicable legal obligations.

The periods or criteria used are mainly the following:

Order and invoice data

Data associated with orders, invoices and financial-accounting documents are kept for the period provided by applicable tax and accounting legislation.

Financial-accounting documents are generally kept for 5 years, calculated from July 1 of the year following the year in which they were prepared, except where the law provides a different term.

Account data

Account data are kept while the account exists.

If you request account deletion, the account will be deactivated or deleted, except for data we are legally obliged or have a legitimate interest to retain, such as information associated with orders, invoices, returns or disputes.

If there is an active order, complete deletion of the account may be carried out after order completion.

Marketing data

Data used for commercial communications are processed until consent withdrawal, unsubscribe or until we determine that the data is no longer current or necessary for the purpose for which it was collected.

We may keep a minimal record of the unsubscribe to ensure that we no longer send you commercial communications.

Requests and complaints

Data associated with requests and complaints are kept as long as necessary to resolve them and thereafter for the period required to defend our rights or comply with legal obligations.

Technical and security data

Technical logs and data necessary for site security are retained for limited periods, determined based on the nature of the information, security risks and the need to investigate incidents.

After the applicable periods expire, data will be deleted, anonymized or archived in accordance with legal obligations.

9. Account deletion

You can request deletion of your customer account:

Deleting the account does not automatically result in deletion of all personal data.

We may retain data necessary for:

  • completing active orders;
  • fulfilling accounting and tax obligations;
  • managing returns and warranties;
  • resolving complaints;
  • fraud prevention;
  • establishing, exercising or defending a right in court.

Account deletion is not automatically equivalent to unsubscribing from all commercial communications. However, where possible, we will interpret an account deletion request as a request to stop commercial communications associated with that account.

You can unsubscribe separately at any time using the link available in commercial messages.

10. Data security

We apply appropriate technical and organizational measures to protect data against:

  • unauthorized access;
  • accidental loss;
  • destruction;
  • modification;
  • unauthorized disclosure;
  • illegal use;
  • cyber attacks.

Measures may include access control, user authentication, backups, system updates, protecting communications, incident monitoring and training of persons with access to data.

No method of electronic transmission or storage can guarantee absolute security. In the event of an incident that may pose a risk to the rights and freedoms of data subjects, we will take the necessary measures in accordance with applicable law.

Right to restriction of processing

In situations provided by law, you may request temporary restriction of how we use your data.

Right to data portability

For data processed automatically based on consent or a contract, you may request to receive the data in a structured, commonly used and machine-readable format.

Under the law, you may request transmission of this data to another controller.

Right to object

You may object to processing carried out based on our legitimate interest, for reasons related to your particular situation.

You may object at any time to processing of data for direct marketing purposes, without needing to provide a reason.

Right to withdraw consent

Where processing is based on consent, you may withdraw it at any time.

Withdrawal of consent does not affect the lawfulness of processing carried out before withdrawal.

Right not to be subject to automated decisions

You have the right, under the law, not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects or similarly significantly affects you.

In the normal operation of the online store we do not intend to make such automated decisions without providing the information and safeguards required by law.

Right to lodge a complaint

You have the right to lodge a complaint with:

The National Supervisory Authority for Personal Data Processing – ANSPDCP

We will respond without undue delay and, generally, within one month of receiving the request.

For complex or numerous requests, the term may be extended as provided by law. In such case, we will inform you of the extension and its reasons.

Exercising rights is, in principle, free of charge. For manifestly unfounded, excessive or repetitive requests, we may apply measures permitted by applicable law.

13. Data of minors

The site and the products marketed through it are not intended directly for persons under 18 years of age.

We do not seek to knowingly collect data from minors without the involvement or consent of the legal representative when such consent is required.

If we become aware that we have collected personal data of a minor unlawfully, we will take steps to delete or restrict processing of such data.

Parents or legal representatives may contact us at vanzari@adamssupplements.com if they consider a minor has provided personal data.
